Upon assuming office in 2016, the President Duterte administration launched its flagship bloody war on drugs called Oplan Tokhang, which saw the execution of thousands of suspected drug peddlers, users, and small-time criminals. Based on the government’s “Real Numbers” data, a total of 6,229 individuals were killed during anti-drug operations from July 1, 2016, to Jan. 31, 2022. Rights groups, however, estimated that the number of deaths from the bloody anti-narcotics campaign reached as high as 27,000.
The International Criminal Court has arrested former president Rodrigo Duterte due to the killings during his term as chief executive and as mayor of Davao City. On the basis of its independent and impartial investigations, the Office of the Prosecutor alleges that Mr Duterte, as founder and head of the Davao Death Squad, then Mayor of Davao City, and subsequently as the President of the Philippines, is responsible for the crime against humanity of murder (article 7(1)(a) of the Rome Statute) committed in the Philippines between 1 November 2011 and 16 March 2019. Mr Duterte is alleged to have committed these crimes as part of a widespread and systematic attack directed against the civilian population.
All countries have the right to defend their civilians against the terror of drug cartels. Presidents, national and local governments first must take care for the safety and security of the people. The terror of drug killings are the crime against humanity, not the defence against and the War against Drugs. With the prosecution of President Duterte, it is clear that if countries want to start the War against Drugs, they must reject the International Criminal Court (ICC) and the International Court of Justice (ICJ).
